    Yes, I understand that it was probably the city that dug the hole. But I'm trying to wrap my head around the importance of storing some muddy water and rocks. I seriously doubt that the city would break into a greenhouse and take some glass containers; but, I also seriously doubt that there is something so important in a muddy hole that would require them to go into the greenhouse. So it just seems a little bizarre all over. That's why I suggested having a conversation instead of immediately just slapping lawsuits around.

    I, of course, would also be upset if someone just went into my greenhouse but I still think acts of good faith can go a lot further; especially if you casually insert words into the conversation such "breaking and entering" and "seems like a potential crime or lawsuit" etc. etc. Get the city planners or whatever shaking a little bit and then say to be more careful in the future. They might even be a little more forgiving or leaninent in your dealings in the future.

    You can't sue for breaking & entering because that's a criminal, not a civil matter. As for suing, what are your damages and how do they compare with the filing fee? If it's what you want to do, go right ahead. People can sue for anything, but it doesn't mean they'll win. Given the strong possibility that it really it is your parents' septic system, now's not the time to be antagonizing the town.

    just to point out the completely obvious, if you sue and do not win, you might end up paying the legal costs (if the american system is similar to the english one). this might be rather expensive...
