S. oreophila Yearlings for Bupkis

Hey y'all -

So a very generous member on TF sent me some S. oreo seeds as a gift going on two years ago now. I stratified them, sowed them, and they started growing. Now it's time to give back to the community!

I had them growing under 24-hour fluorescent light. I can't provide proper dormancy and this season it's about time that they get a taste of it, so I'm looking to you guys to take them off my hands!

***NOTE*** This giveaway is not open yet. First I want to ask a few questions to make sure I'm doing this right. Once I'm confident, I'll start collecting numbers and then select amongst them randomly to make sure it's a fair giveaway. ***EDIT*** This giveaway is now OPEN... please see my post #9 to start entering your names.

I'm hoping to ship the plants out this tuesday.

QUESTIONS
  1. Permits are required to sell these plants. I'm not selling them, so my understanding is that I don't need a permit. However, were I to ask the recipients to cover shipping, would I be breaking any laws?
  2. Some of the plants just didn't grow. The tallest are around 3" high, the shortest are 1/2" or so. How tall/mature should one of these plants be before attempting to ship it? This'll give me an idea of how many of these plants I can actually give away.

***RULES*** As these plants are rare and these particular plants *NEED* to be put through dormancy this year. You *MUST* be able to provide these plants with the proper conditions, both during summer and winter... unlike me! I will not quiz you on your methods or conditions or make you write an essay or anything like that ... this is just on the honor system. Nevertheless, please do ask yourself whether you can care for these plants before you enter.

Thanks Heli. Like I said, this isn't open yet. Once I've got a few more opinions here, I'll post up and have folks start picking numbers. So stay tuned!
 
I would like to know the answer to your legal question as well, though I suspect it should be no problem. All of them would probably be OK shipping, but I personally would only send out some of the larger ones just to be safe (over 2 inches?). I'm no authority though, just a humble opinion.
 
I know you can send them as a gift.I think you can charge shipping as I received one years ago in a giveaway.I'm not 100% on that so maybe more people will answer your question.
 
1) all expenses including shipping must be covered by sender unless shipping in-state. Sender not allowed to receive anything in return (trades) out of state. Selling requires no permit work, but must also be within state- out of state selling is prohibited under most circumstances.

2) size difference a result of genetic variation. You get tall ones, short ones, robust ones, runts... Shipping depends on plant size and skill of packing. I'd be comfortable shipping at half dollar sized seedlings (in circumference)
 
Man yours are doing really well! Mine are shrimpy compared to yours still.

Amphirion, by your guidelines it looks like I have 12 plants out of 20 that are big enough to ship safely.

***HOW TO ENTER***
Please choose a number between 1 and 200. I'll close this on Monday evening (4.16) to prepare to ship them Tuesday morning.

Enter your number on the list below. When I draw numbers randomly, I'll choose the folks who guessed closest to the number that came up. This will determine the size of the plant you get... regardless of when you entered, if your number comes up first, you will get a larger plant than the member whose number comes up second

As long as you are not shipping them across state or international lines no permit is required and you may sell, trade or barter them.

Shipping is a gray area. Dr. Wurm contacted someone at Fish and Games and they said it was ok. Bugweed who as been growing Sarracenia for maybe 50 years says otherwise.

I suspect the answer you get from Fish and Games will depend on who you talk to and when you talk to them and you'll get a different answer each time. And as such it will rest on the decisions of the agents, judge and juries involved.

I would advise you strongly to play it safe and cover the shipping yourself unless it is within the same state you are shipping them from.

@NaN - thanks for that detailed answer. I'll take your advice and cover shipping myself. I expected that to be the case when I first sowed these seeds and decided to give them away when old enough, so I was prepared for it!

That settles it - these plants will come at zero cost to YOU, the lovely members of TF.
